This disclosure is designed to take The Hassle out of Selling.

In the past, the Seller sets the sales price of his/her property.  A Buyer offers to purchase the property assuming the property is in good condition. The Buyer uses his/her inspection period to investigate the condition of the property and usually hires a Professional Inspector who gives them a written report. The Buyer may discover problems with the property that the Seller was not aware of and thus did not disclose. The Buyer may then ask the Seller to pay for the repair work, reduce the price, or threaten to cancel the transaction.  Negotiations can begin all over again. The property could be off the market for 30 days by this time.   This is part of the Hassle. The Seller thought he/she had the property sold and now he/she has to begin to negotiate again or stands to lose the Buyer.

We believe that if the Buyer has the information contained in the Termite Report, Home Inspection Report, Well Report, Septic Inspection and/or other Disclosure Reports at the time he/she signs the Purchase Contract, he/she will not need to reopen negotiations on this information. Negotiations would be needed on new findings only.  An example of a new finding on a residential property would be a Roof Inspection that was recommended on the Termite Report or Home Inspection Report. The Buyer could ask the Seller for roof repairs based upon the Roof Inspection Report.   Therefore everything disclosed at the time of the signing of the Purchase Contract becomes part of the Contract. Only New Findings are open to further negotiation. This takes most of The Hassle out of Selling!
